Premium Processing Suspended for I-129 and I-140 Petitions

On March 20, 2020, USCIS announced the temporary suspension of premium processing for all I-129 and I-140 petitions due to the Coronavirus Pandemic. This includes:

Form I-129: E-1, E-2, H-1B, H-2B, H-3, L-1A, L-1B, LZ, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1, R-1, TN-1 and TN-2.

Form I-140: EB-1, EB-2 and EB-3.

As of March 20, USCIS will not accept any new requests for 15-day premium processing and will reject the Form I-907 and return the $1,440 filing fee.  USCIS will continue to premium process any petition accepted for processing prior to March 20 (assuming it was filed in accordance with premium processing criteria).

Also, any petitions already filed with premium processing will not receive approval notices using any pre-paid envelopes (e.g. FedEx, UPS, etc.) USCIS intends to send batches of approval notices via regular mail.

We do not know when premium processing will be re-instated but will inform clients once this information is released.
